Unreasonable Opponent

Litigation, negotiations, mediations can be rough and tumble, no-holds-barred affairs.  You will encounter situations where opposing counsel puts forth assertions which appear unethical or unreasonable.  And that may be the case.  But keep in mind the possibility that the opposition may actually believe that ridiculous position, through client representation or a misunderstanding of facts.  Giving that small benefit of the doubt may save a great deal of time, money and aggravation for all concerned.  You can always pull out the hammer and tongs if needed.
